1. Introduction
Welcome to Quizbids ("we", "us", "our"). These Terms and Conditions govern your use of our website at quizbids.com and our services. By accessing or using our platform, you agree to be bound by these terms.
Please read these terms carefully before using our services. If you do not agree with any part of these terms, you must not use our website.
2. Definitions
- "Platform" refers to the Quizbids website and all associated services
- "User" refers to any person who registers for and uses our services
- "Seller" refers to a user who creates draws and lists items
- "Draw" refers to a competition listing created by a seller
- "Token" refers to the virtual currency used to enter draws
- "Entry" refers to a submission to enter a draw
3. Eligibility
3.1 Age Requirement
You must be at least 18 years old to use our services. By registering for an account, you represent and warrant that you are at least 18 years of age.
3.2 Jurisdiction
Our services are intended for users in the United Kingdom. By using our platform, you confirm that you are legally permitted to participate in skill-based competitions in your jurisdiction.
3.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. How Quizbids Works
4.1 Token Purchase
Users purchase tokens to enter draws. Each token costs £1.00. Tokens are non-transferable and can only be used on the Quizbids platform.
4.2 Entering Draws
To enter a draw, users must:
- Have sufficient tokens in their account (1 token per entry)
- Answer the skill-based question correctly
- Submit their entry before the draw closing date
Users may enter the same draw multiple times. Multiple entries slightly increase the chances of winning but do not guarantee success.
4.3 Skill-Based Competition
All draws on Quizbids require users to answer a question correctly to enter. This ensures that our platform operates as a skill-based competition, not a lottery. Incorrect answers will not result in an entry, but the token will not be deducted.
5. Reserve System
5.1 Reserve Amounts
Each draw has a minimum reserve amount set by the seller. For a draw to proceed, the total value of entries must meet or exceed this reserve by the draw date.
5.2 Reserve Not Met
If the reserve is not met by the draw date:
- The seller may extend the draw to a new date
- The seller may cancel the draw
- If cancelled, all participants will receive a full refund of tokens used to enter
5.3 Refunds
Refunded tokens will be credited back to users' accounts and can be used for other draws. Tokens are refunded, not cash. To receive a cash refund, please contact customer support.
6. Winner Selection
6.1 Random Selection
When a draw's reserve is met and the draw date is reached, one winner is selected at random from all valid entries. Each entry represents one chance to win.
6.2 Winner Notification
Winners will be notified via email and through their Quizbids account. Winners must respond within 14 days to claim their prize.
6.3 Prize Fulfilment
Sellers are responsible for delivering prizes to winners within 28 days of winner confirmation. Quizbids facilitates the connection but is not responsible for prize delivery.
7. Seller Obligations
7.1 Accurate Listings
Sellers must provide accurate, truthful descriptions of items. Images must genuinely represent the item being offered.
7.2 Prize Delivery
Sellers agree to deliver prizes to winners in the condition described, within 28 days of winner confirmation.
7.3 Questions
Sellers must set reasonable questions that have a clear, definitive answer. Questions must not be impossibly difficult or require specialist knowledge.
8. Platform Fees and Payments
8.1 Revenue Split
When a draw is completed:
- 5% of the total draw value is retained by Quizbids as a platform fee
- 95% is paid to the seller
8.2 Payment Processing
All payments are processed securely through Stripe. We do not store your full payment card details.
8.3 Payout Timing
Seller payouts are processed within 7 working days of draw completion, subject to verification checks.
9. Prohibited Activities
Users must not:
- Create multiple accounts to circumvent limitations
- Use automated systems or bots to enter draws
- Manipulate or attempt to manipulate the draw selection process
- List counterfeit, stolen, or illegal items
- Provide false or misleading information
- Harass, threaten, or abuse other users
- Attempt to hack, disrupt, or damage the platform
10. Account Suspension and Termination
10.1 Our Rights
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users.
10.2 Effect of Termination
Upon termination:
- Active entries remain valid until draw completion
- Unused tokens may be refunded at our discretion
- Access to the platform will be revoked
11. Intellectual Property
11.1 Platform Content
All content on the Quizbids platform, including text, graphics, logos, and software, is owned by Quizbids or our licensors and is protected by copyright and other intellectual property laws.
11.2 User Content
By uploading content to our platform, you grant Quizbids a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with our services.
12. Disclaimers and Limitation of Liability
12.1 Service Availability
We strive to keep our platform available at all times, but we do not guarantee uninterrupted access. We may suspend services for maintenance or updates.
12.2 No Guarantee of Winning
Purchasing tokens and entering draws does not guarantee winning any prize. All outcomes are determined by random selection from valid entries.
12.3 Third-Party Items
Quizbids is not responsible for the quality, safety, or legality of items listed by sellers. Users enter draws at their own risk.
12.4 Limitation of Liability
To the maximum extent permitted by law, Quizbids shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of profits, data, or opportunity
- Damages arising from seller non-performance
- Damages exceeding the amount you paid to us in the 12 months prior to the claim
13. Disputes and Complaints
13.1 Customer Support
If you have a complaint or dispute, please contact us first at hello@quizbids.com. We will make reasonable efforts to resolve issues.
13.2 Dispute Resolution
If we cannot resolve a dispute informally, you may pursue resolution through the Online Dispute Resolution platform provided by the European Commission.
14. Changes to Terms
We may update these terms from time to time. Significant changes will be notified via email or prominent notice on our website. Continued use of our services after changes constitutes acceptance of the new terms.
15. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Responsible Gaming
While our platform is skill-based, we encourage responsible participation:
- Only spend what you can afford
- Set personal limits on token purchases
- Take regular breaks
